I think what was slipped in here has nothing to do with interstate commerce. If the IRS is in charge of enforcement (as it would seem) then the mandate is a tax disguised as a social benefit. In other words the legislative logic is "If you drive a car you need a license and insurance. So, if you are alive you need health insurance. What next a license and pet tags for your kids? Kidding aside - the healthcare system is mandated by law to care for the uninsured. So, are we with that? Maybe the courts will address that issue.
